Bloomington, Indiana jury enters verdict in favor of Indianapolis surgeon represented by Eichhorn & Eichhorn, LLP

David Beach and Brett Clayton successfully defended a medical malpractice case filed against an Indianapolis surgeon and her practice. The surgeon performed a laparoscopic Roux-en-Y gastric bypass. After the surgery, the patient experienced a staple line failure and internal bleeding, and eventually died. The case was presented to a Bloomington, Indiana jury over the course of two weeks. The plaintiff alleged that the patient was not a proper candidate for the surgery, and that the patient was not appropriately monitored for bleeding post-operatively. The plaintiff’s attorneys requested that the jury return a verdict in excess of $2.5 million. In response, David and Brett showed the jury that all of the surgeon’s care was appropriate, and that the surgeon was not responsible for the patient’s death. Rather, the patient experienced an unfortunate complication, and, despite appropriate efforts, did not survive. The jury deliberated for just over an hour before returning a verdict in favor of the surgeon and her group.
