Eichhorn & Eichhorn, LLP obtains summary judgment for City of Hammond, Indiana
John McCrum and Robert Feldt obtained summary judgment for the City of Hammond in a case in which the plaintiffs alleged that their son, an IEP high school student, was the victim of excessive force and battery. The plaintiffs' federal lawsuit claimed that a Hammond police officer, serving as a high school security guard, injured their son while apprehending him at school. Motions for summary judgment were filed, claiming qualified immunity and the "enforcement of law" exception under the Indiana Tort Claims Act. The Northern District of Indiana judge agreed that the City of Hammond was not liable and entered summary judgment in its favor.
