Lake County jury enters verdict in favor of surgery center represented by Eichhorn & Eichhorn, LLP

Trenton Gill and David Beach successfully defended a medical malpractice case filed against a Northwest Indiana out-patient surgery center and two nurses. The patient presented to the facility to undergo a colonoscopy and esophagogastroduodenoscopy (EGD/gastroscopy) to evaluate his abdominal pain/gastritis/diverticulosis. The patient was given preoperative intramuscular injections of Robinul and Vistaril into the buttocks. Shortly after the procedure, the patient experienced numbness and pain in the lower left leg. The patient contended that the nurses were negligent in administering the injection and failed to have a physician evaluate the injury after it occurred. Trent and David argued that the nurses properly gave the injection. To the extent the patient suffered any problems with his nerve, it was a complication that can occur despite proper care. They also argued that plaintiff’s alleged injury was also secondary to pre-existing medical conditions. After four days of trial, the jury concluded that there was no medical malpractice and returned a verdict in favor of the nurses and the surgery center.
