Judge enters summary judgment in favor of internist represented by Eichhorn & Eichhorn, LLP

Matt Ver Steeg and Nick Brunette represented a Northwest Indiana internist in a medical malpractice / wrongful death case filed against him. The plaintiff alleged that the doctor negligently prescribed Zetia, a medication used to lower the patient's cholesterol. The patient died approximately two months after the medication was prescribed. The plaintiff contended that the doctor failed to properly monitor the patient after prescribing the medication.  Matt and Nick filed a motion for summary judgment in which they argued that the patient's surviving spouse failed to timely file the lawsuit against her deceased husband's physician. The judge set the motion for hearing, and afterwards agreed that the lawsuit was untimely and granted summary judgment in favor of the internist.
