Indiana Court of Appeals affirms judgment entered in favor of cosmetic surgeon represented by Eichhorn & Eichhorn, LLP

Greg Crisman and Kirk Bagrowski represented a Northwest Indiana cosmetic surgeon in a medical malpractice case filed against him by one of his former patients. The lawsuit claimed that the surgeon did not obtain the patient's informed consent before proceeding with surgeries. However, at trial, the patient failed to present the evidence necessary to meet her burden of proof. Greg and Kirk argued to the court that their client was entitled to have judgment entered in his favor because the patient failed to present the required evidence to establish a claim for medical malpractice. The judge agreed and entered judgment in favor of the surgeon.

The patient's attorneys appealed the case to the Indiana Court of Appeals, contending that the trial court improperly granted motions for partial summary judgment before the trial started.  The Court of Appeals disagreed, and affirmed the trial court's rulings. The opinion can be read by clicking here:
