Judge enters judgment in favor of Northwest Indiana cardiovascular surgeon represented by Eichhorn & Eichhorn, LLP


David Jensen and Megan Brennan successfully defended a medical malpractice case filed against a Northwest Indiana cardiovascular surgeon. The plaintiff brought the wrongful death case against two cardiovascular surgeons, alleging that both surgeons failed to comply with the standard of care in performing a coronary artery bypass graft (CABG) on her husband. During the post-operative course, the patient’s condition deteriorated. He required mechanical ventilation, was severely acidotic, and eventually his abdomen became distended. Films were obtained and showed free air in the patient’s abdomen. During an exploratory surgery, the temporary pacing wires were found to have pierced the transverse colon. The wires were removed and a colostomy was initiated. Despite these measures, the patient later died from overwhelming sepsis. At trial, David and Megan moved for judgment to be entered in favor their client because the plaintiff failed to establish that their client’s alleged negligence deprived the patient a chance for a better outcome. The judge agreed and entered judgment in favor of the cardiovascular surgeon.
