Paul Rake and Brian DeHem obtain summary judgment for City of Hammond
Paul Rake and Brian DeHem obtained summary judgment in a case in which the plaintiff filed suit against the City of Hammond alleging violations of the United States and Indiana Constitution. The plaintiff alleged that the City of Hammond violated the Due Process Clause of the United States and Indiana Constitution by towing over fifty of the plaintiff’s motor vehicles. The plaintiff further asserted that the City of Hammond’s junk motor vehicle ordinance was unconstitutionally vague. Motions for summary judgment were filed, in which various defenses were asserted, including qualified immunity and actual notice. After hearing oral arguments, the Lake County Superior Court granted summary judgment to the City of Hammond on all claims.
