United States District Court for the Northern District of Indiana enters judgment in favor of county jail and contractor represented by Eichhorn & Eichhorn, LLP
Lou Voelker represented St. Joseph County Jail's independent contractor in a 42 U.S.C. 1983 claim filed against the jail and contractor by one of the inmates. The inmate claimed that the jail failed to provide him with proper medical treatment. Lou filed a motion for summary judgment arguing that the inmate's claim was filed beyond the applicable statute of limitations. The Northern District of Indiana agreed, and
concluded that it need not reach the parties' arguments regarding the merits, including application of the deliberate indifference standard and application of the qualified immunity doctrine, because the defendant had correctly asserted that, as a threshold matter, the claim was barred by the applicable statute of limitations.
