Indiana Court of Appeals affirms summary judgment entered in favor of commercial tenant represented by Eichhorn & Eichhorn, LLP
David Jensen and Louis Voelker represent LaPorte Regional Physicians Network ("LRPH") in a negligence claim filed against it by a hospital employee who accidentally contracted HIV while handling laboratory blood samples in a space leased by LRPH. David and Louis filed a motion for summary judgment on behalf of LRPH, contending that it owed no duty of care to the hospital's employee because it had no control over the working environment in which the plaintiff accidentally contracted HIV. The trial court agreed and entered summary judgment in favor of LRPH, and the Indiana Court of Appeals affirmed the trial court.
