Judge grants summary judgment in favor of Fort Wayne attorney represented by Eichhorn & Eichhorn, LLP
Alyssa Stamatakos and Matt Ver Steeg successfully defended a legal malpractice case filed against a Fort Wayne trusts and estates attorney who was sued by a beneficiary to one of the trusts he drafted. The plaintiff alleged that her father did not understand the trust he signed before he died, and blamed the attorney who drafted the trust. The trust required three of the four beneficiaries to pay all of the estate taxes upon his death. According to the plaintiff, her father wanted all four beneficiaries to pay a portion of the estate taxes upon his death. However, all of the evidence designated to the court proved that no legal malpractice occurred because the trust effectively carried out the decedent's desires. After considering all of the evidence designated to the court, it granted summary judgment in favor of the attorney.
