Lake County, Indiana judge lifts temporary restraining order, allows sale of Northwest Indiana country club

Eichhorn & Eichhorn, LLP attorneys represent a Lake County real estate development partnership in litigation filed against it by one of its limited partners. The limited partner sought injunctive relief in the form of an order enjoining the sale of the country club, a partnership asset. A hearing was held on the limited partner's motion for a preliminary injunction at which both parites presented witnesses and documentary evidence. After receiving evidence and hearing argument from counsel, the judge dissolved the temporary restraining order and denied the limited partner's motion for preliminary injunction.  The judge concluded that, because the limited partner only sought money damages and had misapplied a provision of the partnership agreement, its remedy at law was adequate and injunctive relief was improper.
