Seventh Circuit rules in favor of insurer represented by Eichhorn & Eichhorn, LLP
David Jensen and Robert Feldt represent Medical Assurance Company, Inc. (MAC) in a declaratory judgment action filed against one of its insureds. The action was filed against the insured because he failed to cooperate in the defense of hundreds of legal claims filed against him. Instead of cooperating, the insured fled to Europe. In their appeal, David and Robert argued that the United States District Court abused its discretion when it stayed MAC’s declaratory judgment action against the uncooperative insured. David represented MAC during oral arguments before the Seventh Circuit on October 29, 2009, which can be heard by clicking here. The Seventh Circuit entered its ruling on June 21, 2010, and ultimately agreed that MAC’s declaratory judgment action should proceed on the merits.
