Summary judgment entered in favor of Syracuse attorney and law firm represented by Eichhorn & Eichhorn, LLP

John Twohy, Nick Brunette, and Mark Schocke obtained summary judgment for a Syracuse, Indiana attorney and law firm in a legal malpractice case filed against them. The plaintiff alleged malpractice during the approval of a sewer cost-recapture agreement. The plaintiff demanded $300,000 in damages. A motion for summary judgment was filed, arguing that the undisputed material facts demonstrated that the attorney used ordinary skill and knowledge in representing the plaintiff, that the attorney’s conduct did not cause the alleged damages, and that the damages had not been proven. The Kosciusko Superior Court agreed that no genuine issues of material fact existed, and the attorney and law firm were entitled to judgment in their favor as a matter of law.
